Terms of Service
1. Acceptance
By creating an EcoGPT account or otherwise using the Service, you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service. These Terms form a binding contract between you and EcoGPT.
2. Your account
You may sign in to EcoGPT using a supported identity provider such as Apple or Google. You are responsible for safeguarding your account credentials and for any activity that occurs through your account. Notify us promptly at team@ecogpt.co if you suspect unauthorized access.
3. Acceptable use
You agree not to use EcoGPT to:
- Violate any law or regulation, or infringe anyone's rights;
- Generate or distribute child sexual abuse material, non-consensual intimate imagery, or content that promotes self-harm;
- Harass, defame, or impersonate any person or entity;
- Attempt to reverse-engineer the Service, probe for security vulnerabilities, or otherwise interfere with normal operation;
- Scrape, mass-export, or resell EcoGPT outputs;
- Use the Service to develop a competing AI model.
4. Your content
You retain all rights to the messages, files, and other content you submit to EcoGPT (“Your Content”). You grant us a limited license to host, process, and display Your Content solely to operate the Service. We will not use Your Content to train models without your explicit opt-in.
5. AI output
EcoGPT generates responses using machine-learning models. Outputs may contain inaccuracies, omissions, or content that does not reflect your views. You are responsible for evaluating outputs before relying on or publishing them. Do not use EcoGPT as a substitute for professional advice (medical, legal, financial, or otherwise).
6. Service availability
We work hard to keep EcoGPT up, but we do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time, with reasonable notice when feasible.
7. Fees
EcoGPT is currently free for personal use. If we introduce paid tiers, prices and terms will be presented before you commit to them. We will not retroactively charge you for use you have already had.
8. Intellectual property
The EcoGPT name, logo, and underlying software are our property or that of our licensors. These Terms do not grant you any right to use our trademarks except where necessary to refer to EcoGPT in factual descriptions.
9. Termination
You can stop using EcoGPT at any time. We may suspend or terminate your access if you breach these Terms, expose us to legal risk, or use the Service in a way that materially harms other users. Sections of these Terms that by their nature should survive termination will do so.
10. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ECOGPT WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE PRIOR TWELVE MONTHS OR (B) USD $100.
12. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute must be brought in the state or federal courts located in San Francisco County, California.
13. Changes to these terms
We may update these Terms occasionally. When we do, we will revise the “Last updated” date and, for material changes, notify you in-app. Continued use after the change takes effect indicates acceptance.
