Acceptance of Terms

By creating an account or using EcoGPT, you confirm that you are at least 13 years of age and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Description of Service

EcoGPT is an AI-powered assistant designed to help users with various tasks while promoting environmental awareness. The Service includes:

• AI-powered chat and conversation features
• Image analysis and generation capabilities
• Environmental impact tracking
• Web and mobile applications

User Accounts

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete information when creating your account
• Maintain the security of your account credentials
• Promptly notify us of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our sole discretion.

Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe on the intellectual property rights of others
• Generate, upload, or share illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable content
• Attempt to gain unauthorized access to the Service or its related systems
• Interfere with or disrupt the Service or servers connected to the Service
• Use the Service for any form of automated data collection without our consent
• Impersonate any person or entity or misrepresent your affiliation
• Use the Service to generate content that promotes violence, discrimination, or hatred
• Attempt to reverse engineer, decompile, or extract the source code of the Service

Subscription and Payments

EcoGPT offers both free and paid subscription tiers. For paid subscriptions:

• Payment is processed through our third-party payment processors (Stripe for web, Apple for iOS, and Google Play for Android)
• Subscriptions automatically renew unless cancelled before the renewal date
• You may cancel your subscription at any time through your account settings or the respective app store
• Refunds are handled according to the policies of the respective payment processor
• We reserve the right to change subscription prices with reasonable notice

Deleting your account does not cancel an active subscription. You must cancel through the app store or billing portal where you purchased the subscription.

Intellectual Property

The Service and its original content, features, and functionality are owned by EcoGPT and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of any content you create or upload to the Service. By using the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process your content solely for the purpose of providing and improving the Service. We do not train foundational models on your data.

Third-Party AI Processing

To generate responses, we transmit your content—including messages, relevant conversation history, uploaded images and files, voice audio, and saved memories and personalization when enabled—for processing on our primary dedicated model deployment, hosted in Google Cloud's europe-north1 region in Hamina, Finland. When that deployment is unavailable, requests are routed through OpenRouter to model providers. During an outage, all affected requests may use this fallback. Other features transmit the content they need to the specialist providers named in our subprocessor list.

For requests routed through OpenRouter, we select providers that do not use prompts or outputs to train models. This restriction does not itself guarantee zero data retention; providers may retain data for service delivery or security under their applicable terms. The additional restrictions on Google user data in our Privacy Policy apply to that data and content derived from it.

AI-Generated Content

The Service uses artificial intelligence to generate responses and content. You acknowledge that:

• AI-generated content may not always be accurate, complete, or up-to-date
• You should not rely on AI-generated content for medical, legal, financial, or other professional advice
• You are responsible for reviewing and verifying any AI-generated content before use
• We do not guarantee the accuracy or reliability of any AI-generated content

You own the responses generated for you, to the extent permitted by law. Responses may be similar to responses generated for other users, and no exclusivity is granted over similar responses.

Advertising

The free tier is supported by advertising. Sponsored suggestions are clearly labeled. As described in the Data Sharing section of our Privacy Policy, conversation context may be used and shared with advertising partners to select relevant sponsored content.

Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Service is free of viruses or other harmful components.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ECOGPT, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid us, if any, during the twelve (12) months preceding the claim.

Indemnification

You agree to defend, indemnify, and hold harmless EcoGPT and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

You may terminate your account at any time by contacting us or using the account deletion feature in the Service. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware.

Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use the Service after any revisions become effective, you agree to be bound by the revised terms.

Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. The invalid or unenforceable provision will be modified to the minimum extent necessary to make it valid and enforceable.
